1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and AstroJson ("we," "our," or "us") governing your access to and use of the AstroJson API, website, and related services (collectively, the "Service"). By creating an account, using the API, or otherwise accessing the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. The Service is not intended for users under 16; we do not knowingly collect personal data from such users.

3. Account and API Key

You must register for an account and keep your credentials (including your API key) confidential. You are responsible for all activity under your account. You must notify us immediately of any unauthorized use. We may suspend or terminate your account and API access for breach of these Terms, fraud, abuse, or at our discretion with notice where required by law.

4. Acceptable Use

You agree not to:

• Use the Service in violation of any applicable law or regulation.
• Exceed your subscription tier limits or circumvent rate limits or access controls.
• Share, sell, or transfer your API key to third parties except as necessary to operate your own applications that consume the API.
• Use the Service to distribute malware, spam, or harmful or illegal content.
• Reverse engineer, decompile, or attempt to derive source code of the Service except to the extent permitted by applicable law.
• Use the Service in a manner that could harm, overload, or impair our or others' systems or networks.
• Resell or redistribute the Service or content in a manner that competes with our offering, unless expressly permitted by a separate agreement.

We may monitor usage and take action (including suspension or termination) for violations of this section.

5. Subscription, Billing, and Refunds

Paid plans are billed through our payment provider (LemonSqueezy). By subscribing, you agree to their terms and to pay all fees associated with your plan. Fees are non-refundable except as required by law or as stated in our refund policy (if any) or in the checkout flow. We may change pricing with reasonable notice; continued use after the change constitutes acceptance. You may cancel your subscription in accordance with the process provided by the payment provider; cancellation will take effect at the end of the current billing period.

6. Intellectual Property

We (or our licensors) own all rights in the Service, including the API, website, branding, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms. You do not acquire any ownership rights. Horoscope and other content generated or provided via the API may be subject to usage restrictions; you are responsible for using such content in compliance with these Terms and applicable law. You retain ownership of your applications and data; you grant us a license to use your data as necessary to provide and improve the Service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. HOROSCOPE AND ASTROLOGY CONTENT IS FOR ENTERTAINMENT PURPOSES ONLY AND SHOULD NOT BE RELIED UPON FOR DECISIONS OF ANY KIND.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASTROJSON AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED DOLLARS USD IF GREATER). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless AstroJson and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party rights; or (d) any content or data you submit or use in connection with the Service.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access immediately for breach of these Terms, or with reasonable notice for other reasons. Upon termination, your right to use the Service ceases. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and governing law) will survive termination.

11. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which AstroJson operates (without regard to conflict of law principles). Any dispute arising out of or related to these Terms or the Service shall be resolved in the courts of that jurisdiction, and you consent to personal jurisdiction there. Nothing in these Terms limits your right to lodge a complaint with a data protection or consumer authority where applicable.

12. Changes to the Terms

We may modify these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. For material changes, we may notify you by email or through the Service. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service and may terminate your account.

13. General

These Terms, together with our Privacy Policy and any other policies or guidelines we publish, constitute the entire agreement between you and AstroJson regarding the Service. Our failure to enforce any right or provision does not waive that right or provision. If any provision is held invalid or unenforceable, the remaining provisions remain in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates any partnership, joint venture, or agency relationship.
